Botanical Solutions provides professional tree care, lawn care, pest control, and related landscaping services in New York and Connecticut. These Terms and Conditions (“Terms”) govern your use of our Website and the services we provide. By accessing or using our Website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Website or services.
SCOPE OF SERVICES
Botanical Solutions offers a range of professional landscaping and property care services, including but not limited to: arborist and tree care services, lawn care and maintenance, aeration, tree removal and pruning, tick and mosquito control, weed control, plant health care, and pest control. All services are provided by trained professionals and, where applicable, ISA Certified Arborists. Service availability may vary by location and season. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
SERVICE AGREEMENTS AND ESTIMATES
All services are subject to a written or verbal agreement between the client and Botanical Solutions. Estimates provided are based on our assessment at the time of inspection and are subject to change if site conditions differ from those observed during the initial assessment. Final pricing may be adjusted based on actual conditions encountered during service delivery. An estimate does not constitute a binding contract until accepted by both parties. Cancellations must be made at least 24 hours before the scheduled service date. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee.
CLIENT RESPONSIBILITIES
Clients are responsible for providing accurate information about their property and any known hazards, including but not limited to underground utilities, irrigation systems, septic systems, property boundaries, and any relevant homeowner association rules. Clients must ensure clear and safe access to the work area on the scheduled service date. Botanical Solutions is not responsible for damage to unmarked utilities, irrigation lines, or other underground structures. If pets are present on the property, clients should secure them during service.
Payment Terms
Payment is due upon completion of services unless otherwise agreed upon in writing. We accept payment by check, credit card, and other methods as communicated at the time of service. For recurring services or larger projects, a payment schedule may be arranged. Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend or discontinue services for accounts with overdue balances. Warranties and Guarantees
Botanical Solutions strives to deliver high-quality results. However, due to the nature of landscaping and tree care, we cannot guarantee specific outcomes, as results may be affected by weather, soil conditions, pests, disease, and other environmental factors beyond our control. Any warranties on specific services, such as plant health care treatments or pest control applications, will be communicated in the service agreement. Warranty claims must be submitted within 30 days of service completion. Botanical Solutions will inspect and address legitimate warranty claims at our discretion.
Limitation of Liability
To the fullest extent permitted by law, Botanical Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our Website or services. Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim. We are not liable for damage caused by acts of nature, pre-existing conditions, or circumstances beyond our reasonable control. Botanical Solutions carries appropriate insurance coverage for our services. Proof of insurance is available upon request.
